THIS DOCUMENT IS A LEGALLY BINDING CONTRACT between the Purchaser and Seller of X22 Snowboarding, P4 Enterprises LLC.

Use and Description of Equipment:
Snowboard spike pad/stomp pad is a rubbery, foamy or metal (or whatever material that has high friction) pad that is attached to the top of the snowboard so you can stand on it, when your back foot is not strapped into the snowboard binding. Snowboard surface is slippery, especially when it is wet from snow. When your back foot is unbuckled like, when you go on a ski lift, get off the ski lift or just traverse a flat section of the slope, you put your back foot on the spike pad/stomp pad. Because the stomp pad is generally made of rubber (and has an anti-skid profile) and so are the soles of our snowboard boots, they stick together much better than snowboard boots and the snowboard surface. With spike pads/stomp pads we can even make some easy turns, use the edge of the snowboard, and stop when we need to without wiping out.
Spike pads/stomp pads are very useful for beginners and not so experienced riders. Spike pad/stomp pad helps them control the snowboard when the back foot is out of the binding. Now if we are really experienced and have total control of our snowboard we can do all that without the spike pad/stomp pad. But spike pad/stomp pad makes it easier.
Spike pads/ stomp pads come with a layer of strong double sided tape on the bottom side. First thing you need to do is to mark the spot where you will put your spike pad/stomp pad. Spike pad/stomp pad sits right in front of your back binding, that means in between the snowboard bindings. Put your snowboard boot just in front of the back binding and make a spot under the center of the boot. This will help you not to glue your spike pad/stomp pad too close to your binding, where you can’t stomp it so well. Next thing you need to do, when attaching a spike pad/stomp pad, is to clean the top of your snowboard. Remove all of the dust, oil or soil and other stuff from the deck. Wipe it clean and let it dry. Make sure you are indoors. If it is too cold, the glue gets harder and it will be less durable. Also, do not wipe off the X that marks where to put your spike pad/stomp pad.
And finally, remove the paper/plastic/whatever from the bottom of the spike pad/stomp pad and place it firmly on the snowboard. Keep the pressure on for a while and you are set to go. If you have enough time, it is better to leave the spike pad/stomp pad under pressure (put some heavy books on it) for 24 hours before using it. It will stay on longer.

Contractual Agreement:
I, the purchaser, verify that the personal information (INCLUDING AGE) on this form is correct. I have read the instructions on the use of X22 spike pad. If at any time I feel that the equipment is not functioning properly, I will stop using it.
NO WARRANTIES: THIS PRODUCT IS SOLD “AS IS.” THE SELLER, X22 SNOWBOARDING/P4 ENTERPRISES LLC, MAKES NO REPRESENTATIONS, PROMISES OR WARRANTIES, EXPRESS OR IMPLIED, AND HEREBY DISCLAIMS ALL WARRANTIES INCLUDING ANY IMPLIED WARRANTY AS TO THE MERCHANTABILITY OF THE GOOD OR FITNESS OF THE GOOD FOR A PARTICULAR PURPOSE.
Purchaser understands and is aware that snowboarding can be dangerous, and involves RISK OF INJURY to any and all parts of the body. Purchaser further understands that injuries in the sport of snowboarding are a COMMON ORDINARY OCCURRENCE and freely accepts and assumes those risks OF INJURY OR DEATH that may occur while using this equipment.
Purchaser understands that the X22 spike pad/stomp pad CANNOT PREVENT INJURY, that it is not possible to predict every situation, and that its use CANNOT GUARANTEE MY SAFETY or freedom from injury when I participate in the sport of snowboarding. I agree and understand that this X22 spike pad/stomp pad may not necessarily reduce NOR ELIMINATE THE RISK of injuries to the lower portion of the user’s legs, to the user’s knees or any other part of the user’s body.
Purchaser hereby agrees to RELEASE FROM LIABILITY, and to INDEMNIFY AND HOLD HARMLESS X22SNOWBOARDING/P4 ENTERPRISES LLC, and its owners, agents, and employees, from any and all liability for injuries, death or damages resulting from or related use of X22 spike pads/stomp pads. I FURTHER AGREE NOT TO MAKE A CLAIM OR SUE FOR INJURIES OR DAMAGES RELATING TO THE USE OF THIS EQUIPMENT, whether such claim is based on a theory of NEGLIGENCE, breach of warranty, product defect or any other theory.
This agreement constitutes the final, complete, exclusive and entire statement of the agreement of the parties with respect to the subject matter thereof. This agreement further supersedes all prior communications, understandings and agreements relating to the subject matter hereof, whether oral or written.
This agreement shall be interpreted and construed according to, and governed by, the laws of the State of Nevada.
If any part of this Agreement is deemed void or unenforceable, the remainder shall be given full force and effect. The specific rights of the parties under this contract may vary from state to state.
I, the purchaser, HAVE READ, UNDERSTAND AND AGREE TO THE WARNING, RELEASE AND AGREEMENT. I fully understand the release of liability provisions it contains. I am aware that this is a release of liability and a contract between myself, and X22 Snowboarding/P4 Enterprises LLC, and I sign it of my own free will. These waivers and obligations extend to my heirs and assigns.
